Introduction
By accessing or using this website (www.shifo.org) or Shifo's digital health platforms (including the MyShifo app, Clarity, and CV2, where applicable), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Website or Services. We may update these Terms periodically.
1. Use of the Website and Services
You agree to use the Website and Services lawfully and in a way that does not infringe the rights of, or restrict or inhibit, anyone else's use and enjoyment of them.
- Contributions you make (comments, campaign content, etc.) must be your own, civil, and lawful. Shifo may remove content it considers inappropriate.
- Individuals under 18 should have parental consent to donate or join the Shifo community.
- These Terms are governed by Swedish law and subject to the exclusive jurisdiction of the courts of Sweden.
2. Digital Health Platforms (MyShifo, Clarity, CV2, and Related Services)
Where Shifo provides digital health platforms and services to health facilities, ministries of health, programme partners, or their authorised users, the following additional terms apply, in conjunction with any separate services agreement in place with that organisation:
- Authorised users (e.g., health workers, facility administrators) must use the Services only for legitimate health-programme purposes and in accordance with the access granted to them.
- Users must not attempt to access data outside their authorised scope, or use patient data for any purpose other than the assigned task.
- Where Shifo processes personal data on behalf of a health facility or programme partner, Shifo acts as a data processor, and processing is governed by the applicable data processing terms and our Privacy Policy.
- Users must promptly report any suspected security incident, unauthorised access, or data breach to Shifo via the channels specified in onboarding materials or the relevant services agreement.
- Availability of the Services is subject to Shifo's Business Continuity and Disaster Recovery practices but is not guaranteed to be uninterrupted; scheduled maintenance and unplanned outages may occur.
3. Account Registration
Where the Website or Services require registration, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for activity that occurs under your account. If you register via a third-party service , you authorise Shifo to access the basic profile information you make available, subject to that third party's own terms.
4. Disclaimers
The Website and Services are provided "as is" without warranty of any kind, express or implied. Shifo uses reasonable efforts to keep information accurate and current but makes no warranty as to its accuracy or completeness.
Changes to these Terms take effect from the time they are posted online; continued use after posting constitutes acceptance. If these Terms conflict with any specific terms on a particular section of the Website, the specific terms shall prevail for that section.
To the fullest extent permitted by law, Shifo will not be liable for any damages including indirect, incidental, or consequential damages, or loss of data or profits arising from use of, or inability to use, the Website or Services, whether based in contract or otherwise. Nothing in these Terms limits liability that cannot be excluded under applicable law, including in relation to gross negligence, willful misconduct, or statutory data-protection obligations.
The Website may contain links to third-party websites. These are provided for convenience; Shifo has no control over and is not responsible for their content. Use of third-party sites is at your own risk and subject to their own terms and privacy policies.
5. Intellectual Property
The Shifo name, logo, website design, and related trademarks are the property of Shifo. You may use content on the Website only for informational and non-commercial purposes to promote Shifo and raise awareness of its work. You may not modify the Shifo logo or misrepresent content from the Website. Shifo's software, source code, and related technical materials remain Shifo's property or that of its licensors, and are not licensed for use by this Agreement except as expressly agreed in a separate written agreement (e.g., an open-source license or services agreement).
6. Data Protection
Your use of the Website and Services is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data, including health-related data processed through our digital health platforms. Where Shifo processes personal data on behalf of a customer or partner under a separate agreement, the terms of that agreement (including any Data Processing Agreement) govern in the event of a conflict with this Section.
7. Termination
Shifo may suspend or terminate your access to the Website or Services at its discretion, including for violation of these Terms, without prior notice where reasonably necessary to protect the security or integrity of the Services or the rights of others.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles, and any dispute shall be subject to the exclusive jurisdiction of the courts of Sweden, except where a separate services agreement with a health facility or programme partner specifies otherwise for that relationship.
